New Jersey Expungement Information & Resources : NJ Law Overview

  1. New Jersey laws allow for expungement of records from any court, detention or  correctional facility, law enforcement or criminal justice agency.  NJSA 2C:52-1(a).
  2. It only applies to criminal records. Matter of M.D.Z., 286 N.J.Super. 82, 668 A.2d 423 (A.D.1995).  It applies to criminal records of corporations.  State v. XYZ Corp., 232 N.J.Super. 423 (1989).
  3. The records do not get modified or destroyed.  Instead, the public generally has no access to the records.  In re T.P.D., 314 N.J.Super. 643, 715 A.2d 1048 (L.1997), affirmed 314 N.J.Super. 535, 715 A.2d 994.  The exceptions are:
    1. Agencies before which a petition to expunge is pending are allowed to see if expungement has been made before.  NJSA2C:52-17.
